Preferred Owner Program: Terms and Conditions

1. Upon receipt of the membership card/key tags (the "Card"), member agrees to be bound by the program rules, terms and conditions.
2. Rewards (the "Points") are earned by making qualified purchases of products and services only at Ferguson Pontiac Buick GMC
3. Members must present valid membership Card at time of purchase in order to accumulate Points.
4. 5% of the total dollars you spend towards a qualified purchase as outlined in the membership materials will be accrued in Points to discount your next service or new or pre-owned vehicle purchase at the Dealership.
5. Each of the Points earned is equal to one dollar in award discounts.
6. Qualified purchases include retail parts, detail, services, maintenance and accessories. New or pre-owned vehicle purchases, body shop services and wholesale parts purchases are excluded from this program. Points are earned on customer pay transactions only. Warranty repairs do not qualify for Points accumulation.
7. Program is limited to a maximum award redemption level of 300 Points towards vehicle purchase and 300 points towards services or parts. Program is limited to a maximum accumulation of 600 points.
8. Points may be accumulated for a maximum of 2 years from the original members start date, but may not exceed the Points maximum accumulation.
9. Membership expires 2 years from the original membership start date. Accumulated Points must be used prior to membership expiration or the Points will be forfeited.
10. Membership and Points may not be transferred from account to account. At no time can Members pool accumulated Points to increase standings. Membership and Points can not be sold, bartered, brokered or transferred for any reason including death and domestic matters. Membership and Points have no cash value.
11. Member's Points standings can be checked at Ferguson Pontiac Buick GMCs scan terminal or online @ www.fergusonpontiacgmc.com.
12. Transaction credits will be posted within 30 days of the qualified transaction date.
13. When redeeming Points towards a vehicle purchase, qualified service / maintenance or retail part members must present a valid membership Card containing their accumulated Points with proper identification.
14. Points may only be accumulated at the time a member makes a qualified purchase.
15. Only one account's Points may be redeemed per vehicle purchase or service/ maintenance or retail parts.
16. Points have no cash value and can not be redeemed for cash.
17. Membership cards remain the property of the Dealership and must be surrendered upon request.
18. Participation in the Preferred Owner Program is offered at the sole discretion of the Dealership and may be terminated at any time without prior notice.
19. The Dealership reserves the right to disqualify any person(s) from participation; if in its sole judgment the member violates the rules, terms and regulations governing this program. In the event disqualification or program termination, accumulated Points will be immediately terminated.
20. All members must be 18 years of age to participate.
21. Accumulated Points may not be redeemed if you are in default under the terms and conditions of these rules or with any obligation which may be due the Dealership.
22. Determination of income or tax liability related to the participation in this program is the sole responsibility of the participating member. Neither General Motors, FMReps Distribution Inc., the Dealership nor any affiliates make any representation as the current or future tax consequences to the participating member as to the crediting, transferring, use, redemption, or disposition of program earnings.
23. The program has no pre-determined termination date. The program may be terminated at any time with out prior notice at the wishes of the Dealership or its affiliates.
24. The Dealership, GM and FMR reserve the rights to audit all accounts for compliance with these rules. In the event the audit reveals discrepancies, the processing of the program earnings may be delayed until such discrepancies are resolved. The Dealership reserves the right to make any and all decisions as to the validity of accumulated Points. All decisions considered final.
25. Corporations, partnerships, and or other entities may not be eligible to participate.
26. Program Points redemption is not combinable with any and all GM Vehicle Purchase Programs including and not limited too: GM Employee Purchase, GM Dealership Employee Purchase and GM Supplier Purchase. Dealership reserves the right to determine redemption eligibility.
27. Program Points redemption is not combinable with any other discount offers. Dealership reserves the right to determine redemption eligibility.
28. Nothing in these rules or in the program shall be construed to establish an agency, partnership, or joint venture relationship between the Dealership, FMR Inc, GM or any other party. FMR Inc., GM nor the Dealership is not responsible and assumes no liability for changes in or discontinuance of a Dealership service, which may affect the program benefits.
29. The Dealership, FMR Inc. and GM reserve the right to change the program rules at any time without prior notice to members.
30. Previous purchase prior to the program not eligible for points accumulation.
